When a business, or part of it, transfers to a new owner, the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) state that its staff will automatically transfer with it, on the same pay, benefits and length of service. 

But, while the principle is simple, the practical application to ensure compliance can be anything but. That’s where we come in.

 

When does TUPE apply?

TUPE can apply in two main scenarios:

  • Business Transfers
    When a business (or part of it) is sold, acquired, or merged.
  • Service Provision Changes
    When a service is outsourced, re-tendered to a new provider, or brought back in-house.

In both cases, employees may transfer to the new employer with their existing terms and conditions intact.
