NHS Continuing Healthcare Funding and reclaiming care home fees

NHS Continuing Healthcare Funding (CHC) is a type of funding provided by the NHS to cover the full costs of a person’s care. Eligibility for CHC is based on an individual’s healthcare needs rather than their age, financial means or diagnosis.

A person qualifies for CHC if their needs are demonstrably

  •  Complex, intense or unpredictable 
  •  Not incidental or ancillary to the accommodation that Social Services is under a duty to provide 
  •  Not of a nature typically provided by Social Services 

There are many reasons why CHC decisions may be wrong. If you have been denied CHC and are paying for care, you may be able to reclaim care fees. Our specialist team are experienced at overturning flawed CHC decisions.   With care home fees in excess of £80,000 per year we can save families thousands of pounds.

 

If you believe a relative has been wrongly charged for their care costs as a self-funder, including if you discover this after your relative has passed away, you may be able to bring a retrospective review. Our specialist team has significant experience of bringing successful retrospective cases, including reclaiming care home fees after death.
