Clarity in a complex world.

When someone loses the ability to manage their own affairs, it can place a huge responsibility on those appointed to act on their behalf. Whether through a Lasting Power of Attorney (LPA), Enduring Power of Attorney (EPA), or a Deputyship, disputes can arise - and they’re often emotionally charged and complex.

Our specialist Contentious Wills, Trusts & Estates Team, working closely with our Court of Protection experts, is here to help you navigate these sensitive situations with clarity and care.

What types of disputes might arise?

Disputes can arise over:

  • Whether the person had capacity when the LPA or EPA was made
  • Who is acting (or proposed to act) as Attorney or Deputy
  • How an Attorney or Deputy is managing finances, property, or welfare
  • Whether decisions are truly in the best interests of the protected person

We’ve helped clients resolve issues such as:

  • Attorneys making unauthorised gifts or misusing funds
  • Disagreements over selling a property after someone moves into care
  • Concerns about how money is being invested
  • Disputes over care arrangements or living situations
  • Contested applications for Statutory Wills
  • Questions about whether someone still has capacity

Who we act for?

We represent:

  • Family members or concerned parties challenging an Attorney or Deputy
  • Attorneys or Deputies facing claims or investigations
  • Individuals disputing the validity of an LPA or EPA
  • Anyone involved in a disagreement about a protected person’s welfare or finances

How are these disputes resolved?

Most cases are dealt with by the Court of Protection, which has its own rules and procedures. In some cases, the Office of the Public Guardian may investigate first.

Where possible, we’ll help you resolve matters through mediation or early neutral evaluation, avoiding the stress and cost of a full court hearing.

Funding your case

In many cases, the protected person’s Estate will cover the legal costs - provided everyone acts reasonably and in good faith. We’ll guide you through the funding options available, including deferred private funding in appropriate cases.

How we can help

We'll support you with:

  • Challenging or defending the actions of an Attorney or Deputy
  • Navigating Court of Protection proceedings
  • Responding to investigations by the Office of the Public Guardian
  • Resolving disputes through Alternative Dispute Resolution
  • Protecting the best interests of the person at the heart of the matter

If you’re involved in a dispute - or worried one might arise - get in touch with our team for clear, compassionate advice.
