Wills (drafting and updating)
Some people put off preparing a Will because they feel the time isn’t right, they’re too young or they’re uncertain about costs. However, making a Will and ensuring it is kept up to date can provide you and your family with real security and peace of mind, allowing you to plan for the future safe in the knowledge that your loved ones are provided for should the unthinkable happen.
The important points to consider in how to make a will include:

Who do you wish to appoint as your executors?

Do you wish to make any specific bequests (legacies)?

Would it be appropriate to include any trusts within your Will, for example to provide long term protection for your estate?

Who do you wish to leave the rest of your estate to?

What are the tax implications of your wishes and can this be made more efficient?
Lasting Powers of Attorney
If you worry about who will manage your affairs or make decisions about your finances or welfare should you become unable to do this yourself, you may find peace of mind by entering into a Lasting Power of Attorney which is a formal document that allows an individual(s) to act on your behalf, be that in respect of your welfare or your finances. Should you ever become unwell or unable to make important decisions, without powers of attorney in place, your loved ones could face a lengthy and expensive application to the Court of Protection to obtain the necessary authority to make decisions on your behalf.
Power of attorney
Tax Efficient Lifetime Planning
We will guide you through the various taxes and how they interact – and provide lifetime tax and inheritance tax planning. On death we will assist your Executors to ensure that all tax issues are considered and any liabilities reduced where possible.
Contested Trusts and Probate
We have a team of specialists at Porter Dodson who deal with contested trusts and probate.
Whether you are contesting a Will, want to make a claim under the Inheritance (Provision for Family & Dependants) Act 1975 or have a problem with how the estate is being administered, we will take the time to understand your needs and objectives, tailoring our advice to suit your circumstances.
We can also help if you are an executor, trustee, personal representative or beneficiary facing a claim about a Will, trust or estate.
